LGPD \u2013 Qual ser\u00e1 o papel do Data Protection Officer (DPO)?<\/strong><\/p>\n

Por for\u00e7a das frequentes not\u00edcias sobre falhas de prote\u00e7\u00e3o, viola\u00e7\u00e3o ou vazamento de\u00a0dados e face ao enorme alcance da dissemina\u00e7\u00e3o de dados por meios digitais, o tema seguran\u00e7a da informa\u00e7\u00e3o assume relev\u00e2ncia e gera a cria\u00e7\u00e3o de leis espec\u00edficas como a Lei Geral de Prote\u00e7\u00e3o de Dados \u2013 LGPD -, que entrar\u00e1 em vigor no Brasil em 2020. Neste cen\u00e1rio, surge o Data Protection Officer (DPO), tamb\u00e9m chamado Encarregado de Prote\u00e7\u00e3o de Dados.<\/p>\n

O DPO atuar\u00e1 como um fiscal interno, administrando o fluxo de informa\u00e7\u00f5es, desde a coleta at\u00e9 o tratamento. Em caso de irregularidade, ser\u00e1 dele a obriga\u00e7\u00e3o de realizar ajustes, adequando a empresa \u00e0 legisla\u00e7\u00e3o brasileira. Seu trabalho\u00a0deve estar alinhado com a \u00e1rea de seguran\u00e7a da informa\u00e7\u00e3o, mas tamb\u00e9m com o departamento jur\u00eddico, para garantir a legalidade dos processamentos adotados. Conforme consta na LGPD, cabe ao DPO:\u00a0\u00a0aceitar reclama\u00e7\u00f5es e comunica\u00e7\u00f5es dos titulares, prestar esclarecimentos e adotar provid\u00eancias; receber comunica\u00e7\u00f5es da autoridade nacional e adotar provid\u00eancias; orientar os funcion\u00e1rios e os contratados da entidade a respeito das pr\u00e1ticas a serem tomadas em rela\u00e7\u00e3o \u00e0 prote\u00e7\u00e3o de dados pessoais; e executar as demais atribui\u00e7\u00f5es determinadas pelo controlador ou estabelecidas em normas complementares. Tais atribui\u00e7\u00f5es tornam a fun\u00e7\u00e3o fundamental nas decis\u00f5es estrat\u00e9gicas e lhe d\u00e3o consider\u00e1vel autonomia.<\/p>\n

Pelas caracter\u00edsticas da atividade, s\u00e3o requisitos para o cargo amplo conhecimento sobre LGPD, compliance, governan\u00e7a de dados pessoais, seguran\u00e7a da informa\u00e7\u00e3o e TI. Especialistas recomendam que as organiza\u00e7\u00f5es nomeiem seus DPOs mesmo antes da vig\u00eancia da LGPD, a fim de antecipar an\u00e1lises e iniciar o treinamento dos colaboradores.<\/p>\n

De acordo com pesquisas do Gartner, a\u00a0privacidade \u00e9 cada vez mais uma quest\u00e3o cr\u00edtica para as organiza\u00e7\u00f5es e vem gerando novos padr\u00f5es de trabalho, bem como a defini\u00e7\u00e3o de requisitos mais rigorosos. A regulamenta\u00e7\u00e3o refor\u00e7a a import\u00e2ncia da prote\u00e7\u00e3o e seguran\u00e7a de dados para os neg\u00f3cios, empresas e clientes, e todos dever\u00e3o se adaptar a isso.<\/p>\n
