Ap\u00f3s adiamentos e discord\u00e2ncias, Senado mant\u00e9m vig\u00eancia da LGPD para agosto de 2020.<\/strong><\/p>\n

A LGPD \u2013 Lei Geral de Prote\u00e7\u00e3o de Dados \u2013, conjunto de normas que obriga as empresas a adotarem processos de seguran\u00e7a para uso e armazenamento de dados digitais no Brasil – j\u00e1 teve seu in\u00edcio de vig\u00eancia anunciado v\u00e1rias vezes. A data, originalmente prevista para agosto de 2020, foi prorrogada para janeiro de 2021 e, atrav\u00e9s da Medida Provis\u00f3ria n.\u00ba 959, novamente adiada para maio de 2021. Na exposi\u00e7\u00e3o de motivos, o Ministro Paulo Guedes alegou \u201c… uma poss\u00edvel incapacidade de parcela da sociedade em raz\u00e3o dos impactos econ\u00f4micos e sociais da crise provocada pela pandemia do Coronav\u00edrus\u201d.<\/p>\n

O adiamento determinado pela MP deu maior prazo para que as empresas \u2013 paradas ou adaptando-se ao home office e vivendo um per\u00edodo de conten\u00e7\u00e3o de custos \u2013 pudessem desenvolver as plataformas exigidas pela LGPD e, consequentemente, maior prazo para que fosse criada a ANPD – Autoridade Nacional de Prote\u00e7\u00e3o de Dados, respons\u00e1vel pela fiscaliza\u00e7\u00e3o e aplica\u00e7\u00e3o de san\u00e7\u00f5es.<\/p>\n

As opini\u00f5es se dividiram. No setor jur\u00eddico, o especialista em prote\u00e7\u00e3o de dados Gustavo Artese, entendeu que, sem a ANPD, um adiamento fosse positivo, mas que \u201co ideal seria que o governo tivesse cumprido seu papel e instalado a ANPD para que a lei seguisse seu caminho natural\u201d. Para o advogado Filipe Fonteles Cabral, a prorroga\u00e7\u00e3o foi \u201cum al\u00edvio para quem deixou o projeto de conformidade para o \u00faltimo minuto, desalento para quem j\u00e1 entendeu a import\u00e2ncia da lei\u201d. No meio econ\u00f4mico, v\u00e1rios segmentos se manifestaram. O setor de relacionamento com o cliente (call center) apoiou a mudan\u00e7a. Top\u00e1zio Neto, vice-presidente da ABT – Associa\u00e7\u00e3o Brasileira de Telesservi\u00e7o, alegou que as empresas trabalhavam para se adequar \u00e0 nova lei, mas a pandemia interrompeu esse processo. A FecomercioSP afirmou que as empresas de grande porte est\u00e3o em vias de adapta\u00e7\u00e3o, mas os varejos de pequeno e m\u00e9dio porte ainda n\u00e3o implementaram as regras da LGPD. J\u00e1, a Febraban n\u00e3o viu o adiamento ou a pandemia como impeditivos para estar em conformidade com a lei, pelo fato de as institui\u00e7\u00f5es financeiras seguirem, rotineiramente, uma forte regula\u00e7\u00e3o.<\/p>\n

Em meio a essas e outras opini\u00f5es divergentes, no dia 19 de maio, a LGPD teve, mais uma vez, seu prazo de vig\u00eancia alterado com a aprova\u00e7\u00e3o, pelo Senado Federal, da manuten\u00e7\u00e3o do in\u00edcio da LGPD para a data original de agosto de 2020, com san\u00e7\u00f5es a partir de agosto de 2021. A decis\u00e3o, no entanto, n\u00e3o elimina o ambiente de incerteza gerado pelo fato de n\u00e3o existir, at\u00e9 o momento, uma normatiza\u00e7\u00e3o clara dos procedimentos nem a implementa\u00e7\u00e3o da ANPD para maior seguran\u00e7a das empresas. N\u00e3o elimina tamb\u00e9m a desconfian\u00e7a sobre a real import\u00e2ncia que os governantes est\u00e3o dando ao tema, independentemente da COVID-19.<\/p>\n

Atrasados em rela\u00e7\u00e3o ao mundo neste quesito, \u00e9 ineg\u00e1vel que a LGPD ser\u00e1 um marco para a prote\u00e7\u00e3o de dados no Brasil e exige total aten\u00e7\u00e3o de controladores, \u00f3rg\u00e3os de fiscaliza\u00e7\u00e3o e tamb\u00e9m das empresas que, ao investir na implementa\u00e7\u00e3o de programas de conformidade e governan\u00e7a, al\u00e9m de evitar penalidades severas, garantem um diferencial competitivo para a seguran\u00e7a de seus clientes e manuten\u00e7\u00e3o de seus neg\u00f3cios.<\/p>\n
