\u00a0\u00a0\u00a0\u00a0 O ataque cibern\u00e9tico ocorrido no Brasil em janeiro deste ano, quando 40 milh\u00f5es de CNPJs\u00a0 e \u00a0223 milh\u00f5es de CPFs (inclusive de pessoas falecidas), al\u00e9m de dados cadastrais e\u00a0informa\u00e7\u00f5es econ\u00f4micas, fiscais, previdenci\u00e1rias, perfis em redes sociais, escore de cr\u00e9dito e fotografias pessoais ficaram vulner\u00e1veis, ilustra bem o que pode acontecer com o vazamento de informa\u00e7\u00f5es sigilosas. O ataque aconteceu na zona da internet conhecida como dark web, parte mais sinistra da nociva deep web, com seus dom\u00ednios voltados para pr\u00e1ticas criminosas. Embora os ataques aconte\u00e7am em todo o mundo, o Brasil figura como um dos pa\u00edses mais vulner\u00e1veis \u00e0 exposi\u00e7\u00e3o a riscos que aumentaram sensivelmente durante a pandemia, com os trabalhos realizados em home office e com o incremento do com\u00e9rcio eletr\u00f4nico.<\/p>\n

\u00a0\u00a0\u00a0\u00a0 A dimens\u00e3o de uma viola\u00e7\u00e3o de dados pode ser rapidamente resolvida, mas essa n\u00e3o \u00e9 a regra. Dias de investiga\u00e7\u00e3o s\u00e3o necess\u00e1rios para se saber por parte de quem e quanto foi comprometido em rela\u00e7\u00e3o \u00e0 privacidade e \u00e0 seguran\u00e7a dos cidad\u00e3os. Nesse per\u00edodo, as informa\u00e7\u00f5es obtidas podem ser vendidas e os cidad\u00e3os expostos a outros tipos de roubos e de fraudes. No mundo corporativo, al\u00e9m de preju\u00edzos financeiros, uma viola\u00e7\u00e3o de dados pode comprometer a imagem, a reputa\u00e7\u00e3o e a credibilidade da empresa, gerar processos judiciais, investiga\u00e7\u00f5es, demiss\u00f5es de funcion\u00e1rios, afetando o andamento dos neg\u00f3cios. Para os especialistas em direito digital, os vazamentos de dados podem ter impacto por muitos anos e dificilmente s\u00e3o revertidos. A dificuldade de se produzir provas na justi\u00e7a tamb\u00e9m faz com que sejam imperativas as investiga\u00e7\u00f5es para se apurar os respons\u00e1veis pelos danos causados e a exemplar puni\u00e7\u00e3o dos envolvidos.<\/p>\n

\u00a0\u00a0\u00a0\u00a0 Diante dos ataques cada vez mais frequentes, especialistas alertam que, com rela\u00e7\u00e3o aos usu\u00e1rios, as atitudes devem ser de conscientiza\u00e7\u00e3o e de preven\u00e7\u00e3o. \u00c9 preciso saber como reagir a liga\u00e7\u00f5es ou recebimento de e-mails e mensagens que solicitem informa\u00e7\u00f5es e dados pessoais. J\u00e1 com rela\u00e7\u00e3o \u00e0s empresas, al\u00e9m da conscientiza\u00e7\u00e3o e treinamento das equipes, \u00e9 preciso investir em seguran\u00e7a da informa\u00e7\u00e3o. A pol\u00edtica de seguran\u00e7a deve detalhar os procedimentos de prote\u00e7\u00e3o de ativos e dados da empresa e ser continuamente atualizada. Deve adotar um termo de responsabilidade no qual os colaboradores se comprometam a cumprir regras espec\u00edficas. \u00c9 importante que as empresas tenham tamb\u00e9m um plano de a\u00e7\u00e3o contra eventuais vazamentos que contemple: an\u00e1lise de impacto nos neg\u00f3cios; levantamento de m\u00e9todos de recupera\u00e7\u00e3o; mapeamento de dados confidenciais e cr\u00edticos; a\u00e7\u00f5es para prote\u00e7\u00e3o; mapeamento dos riscos da estrutura de TI, monitoramento constante da legisla\u00e7\u00e3o sobre viola\u00e7\u00e3o de dados.<\/p>\n

\u00a0\u00a0\u00a0\u00a0 No Brasil, a nova Lei Geral de Prote\u00e7\u00e3o de Dados (LGPD), sancionada em setembro de 2020, visa dar maior seguran\u00e7a \u00e0s informa\u00e7\u00f5es pessoais, obrigando as empresas a criarem barreiras que limitem os ataques de hackers, o que n\u00e3o \u00e9 tarefa simples. Os recursos tecnol\u00f3gicos n\u00e3o t\u00eam sido suficientes para coibir os ataques que continuam acontecendo, mas a exist\u00eancia de uma lei espec\u00edfica para a prote\u00e7\u00e3o de dados \u00e9 vista como um avan\u00e7o.<\/p>\n

Pesquisa da empresa de seguran\u00e7a digital, ClearSale, indica que os ataques ao varejo on-line, no Brasil, aumentaram 53,6% em 2020, em rela\u00e7\u00e3o a 2019.<\/em><\/p>\n
